Attorney Cory Itkin

Attorney Cory Itkin is an aggressive trial attorney who has represented clients in more than two dozen states in cases that range from offshore injuries to truck accidents to plant explosions. When clients are facing high-stakes situations, Cory is proud to be the attorney they trust. When large companies try to take advantage of regular people, Cory fights to level the playing field. He has even been involved in high-profile litigation, such as representing workers injured in the BP Deepwater Horizon explosion.

Cory firmly believes that some of his best work has been when he is facing the biggest challenges. His commitment to making a difference for clients has led to him securing jury verdicts worth more than $1 million on five separate occasions where the defendant made no settlement offer. He has also recovered several seven and eight-figure settlements on the night before trial. Cory is an aggressive negotiator but an even more fierce litigator. Because of this, the other side often realizes that it’s in its best interest to be fair so they won’t have to face Cory during a trial.

Although he is in Houston, Cory has not limited his practice to Texas. In fact, he has been able to achieve numerous settlements and verdicts worth more than $1 million throughout the country. During his legal career, he has been involved in 50+ cases where the verdict or settlement was worth more than $1 million.

Attorney Cory Itkin was proud to attend the University of Texas to receive his undergraduate degree. During his time spent at UT Austin, he remained involved in the school, serving as a representative on the Student Government and as an officer in the Silver Spurs—a student-run organization dedicated to caring for Bevo, the school's longhorn mascot. When he graduated, he enrolled in the University of Houston Law Center. There, he graduated cum laude with several distinctions underneath his belt, such as the Order of the Barons.

Cory has achieved several honors on behalf of his excellent work in the legal field. For example, he has been recognized by Best Lawyers in America® for Admiralty and Maritime Law, by Lawdragon as one of the 500 Leading Plaintiff Consumer Lawyers, by the American Trial Lawyers Association as one of the "Top 100 Trial Lawyers" in Texas, and he has also been selected for inclusion in the Super Lawyers® Rising Stars℠ Edition from 2010 to 2019, as well as the Super Lawyers® Up-and-Coming 100 list.

$222 Million Verdict Won for Widow of Plant Worker

Attorneys Jason Itkin and Cory Itkin obtained a $222 million verdict for a woman whose husband Jesse suffered fatal burns over approximately 90% of his body in a plant accident. Jesse was sent to investigate a steam release from a faulty valve, but when the elevator doors opened, the steam burned Jesse. He was airlifted to a burn unit, but it was too late. $76.6 Million Verdict Secured in Risperdal Case Against Johnson & Johnson

Attorney Jason Itkin and the team of lawyers from Arnold & Itkin won an impressive $76.6 million jury verdict on behalf of a boy who suffered gynecomastia, or irregular female breast growth. The verdict came against Johnson & Johnson and Janssen Pharmaceutical for their drug, Risperdal. The team was also assisted by Cory Itkin and Santana McMurrey from the firm. Both Jason and Kyle provided representation for the boy’s family, bringing a lawsuit against J&J for failing to provide a proper warning that their antipsychotic medicine, Risperdal, could lead to the development of female breasts. This verdict will help ensure that J&J is held accountable for causing such devastating disfigurement to Arnold & Itkin’s client.

J&J and Janssen Pharmaceuticals tried to argue that because their drug was the only drug that worked for the boy, he continued to stay on the drug—even though he was informed of the potential risks. They also tried to argue that Risperdal does not even cause gynecomastia, despite significant evidence that shows otherwise. Our team discovered pivotal evidence through careful cross-examination that was known in the case as “Tab 4.” It became crucial to our case and had never become public until the trial. This included scientific data that showed a clear link between Risperdal and the condition known as gynecomastia. Even though they had this information, J&J knowingly kept this evidence secret, hiding it from the FDA and burying it from scientific studies.

The Philadelphia jury found that Johnson & Johnson was guilty of falsifying, concealing, and/or destroying evidence. After just 11 days of trial, they unanimously agreed that J&J failed to warn of the side effects of Risperdal, thus causing our client to develop gynecomastia. They awarded our client $76.6 million—the largest single verdict in such a case.

$16.5 Million Won for Worker Crushed by Crane Load

Our client was working as a crane rigger when a crane load fell on him, crushing his pelvis. The defendant tried to argue that our client was to blame because he had secured the crane load with the wrong type of hook, but Cory proved these allegations wrong. He and our team completed an in-depth analysis of the plant owner’s financial documents, discovering and proving that construction was behind schedule, and they were using workers (such as our client) for tasks that they were not certified or qualified to perform. Attorneys Jason Itkin, Cory Itkin, and Bradford Hendrickson secured a $9.55 million settlement for a longshoreman from Virginia. While performing his work duties, the longshoreman became the victim of an industrial crane accident. This accident caused the client various injuries resulting in the amputation of one of his legs. Proving accountability in Virginia is critical to an injury case, as Virginia law states that if a client is partially responsible for an injury, he or she forfeits their right to compensation. The defendant argued that the client was at fault for the incident, but Arnold & Itkin lawyers proved that this was not true. As a result, the longshoreman received a fair settlement. The settlement included the $9.55 million payment, an admittance of guilt by the defendant given to the client, a payment of $500,000 for the client’s medical bills, and the creation of a memorial safety award to honor the client’s service and diligence while employed as a longshoreman. Jason Itkin and Cory Itkin helped hold Johnson & Johnson and their pharmaceutical subsidiary, Janssen, accountable for putting profits over patients. They won a pivotal $1.75 million verdict in their pharmaceutical case involving Risperdal. While the drug was sold to treat autism in children, bipolar disorder, and schizophrenia in adults, it actually only had approval for use by adults—not children. As such, our attorneys took fast action when our client came to us showing how the drug had adversely affected his life. Arnold & Itkin acted as trial counsel just one week before the trial took place, effectively demonstrating that the drug had a serious and harmful side-effect, gynecomastia—something the company failed to properly warn of. BP Worker Injured in Crane Accident Receives a $1.72 Million Jury Verdict

Arnold & Itkin LLP secured a $1.72 million jury verdict on behalf of a client who was seriously injured in a crane accident at the BP refinery in Texas City, Texas. Attorney Cory Itkin represented Ernesto Tamez, who was injured in the accident on January 18, 2005.

A negligent Maxim Crane Works crane operator swung a heavy oil burner into Mr. Tamez, causing serious injuries to his neck, back and shoulder when he was pinned between the burner and a nearby handrail. Maxim Crane Works initially made no settlement offer prior to the trial, arguing that the accident was Mr. Tamez's fault. The company claimed that 60-year-old Tamez could have sustained some of the injuries as a result of "wear and tear". An issue that added complexity to the case was that Mr. Tamez and his wife do not speak English and therefore had to testify with the help of a translator.

The jury ruled in favor of Mr. Tamez after the week-long trial. They found that Maxim Crane Works was 100% at fault for the accident and awarded Mr. Tamez and his wife $1.72 million. Through the four years that this case lasted, Arnold & Itkin LLP stood by Mr. Tamez and helped him get the medical attention and financial compensation he needed. $1.7M Jury Verdict Won for Victim of Helicopter Crash

Arnold & Itkin Attorneys Cory Itkin and Caj Boatright represented a victim of a serious helicopter accident. Their client was an offshore fire and safety inspector who was being transported to an offshore platform at the time of the incident. The PHI helicopter experienced a tail rotor failure—causing the pilot to land in the Gulf of Mexico. The helicopter then flipped over in the water after it landed as the flotation devices had not been properly installed. Our client subsequently suffered from PTSD, as well as a severe back injury that eventually required surgery.

PHI argued they had done nothing wrong and that the entire incident could be blamed on the manufacturers of the tail rotor. They went on to claim that our client had not even been injured in the accident; they argued that the two other people who were involved in the crash were not injured and that our client had previously suffered from back problems and depression. PHI claimed that our client had been on pain medication for his back for years and that MRIs from a year prior to the accident were identical to those taken after the fact.

Despite the fact that PHI argued our client was faking his injuries, we stood by our client to successfully beat back the charges. We showed to the jury that our client was entitled to fair monetary compensation for the trauma that he had been put through. Not only were we able to obtain a $1.7M judgment in a jury trial, but we were also able to obtain a settlement with another party before the trial. The jury found that PHI was 100% to blame for the accident and they were therefore not entitled to receive any settlement credit.

Attorney's fees and expenses totaled $936,259.14.

We beat back these allegations and were able to obtain a settlement of $1.65 million.

Attorney's fees and expenses totaled $758,621.98.

$1.6 Million Recovered for Injured Offshore Employee

An offshore platform worker was injured after falling off a wireline on a scaffolding while trying to close a valve. However, the valve failed and released immense pressure. This caused him to fall over backward, injuring his neck to the point of needing surgery. Despite the efforts of the defendants to say that the worker was not to continue working on the broken valve, Maritime Attorney Cory Itkin was able to prove that the injury was preventable and the defendants were in fact responsible for his pain and suffering. They were able to reach a settlement of $1,650,000 on behalf of the injured offshore worker, allowing him now the opportunity to move on with his life. The legal team from Arnold & Itkin, LLP worked together to show fault on behalf of the truck driver and were able to recover a $1,557,500 jury verdict despite the fact that before the case, there had only been a pre-trial offer of a $5000 settlement. It was argued by the defendant that the driver of the yard mule was not at fault since the truck was in the middle of the intersection and that due to the low speed, it was a minor collision. They also argued that the plaintiff had injuries prior to the incident. They only offered to settle for $35,000. Attorneys Jason Itkin and Cory Itkin took on the case and were able to recover a $1.55 million jury verdict. The case was pending in Harris County, TX with the Honorable Jaclanal McFarland.

UPS had previously offered the family a $150,000 settlement before the case went to trial in Harris County, Texas. It takes a unanimous verdict to find a defendant guilty of gross negligence, which goes beyond ordinary negligence. Attorneys Cory Itkin and Ryan MacLeod secured this unanimous verdict to hold UPS accountable for its dangerous working conditions and to recover $1.5 million in compensation for the family.
Attorney's fees and expenses totaled $0.00.

Arnold & Itkin, LLP Attorneys Kurt Arnold & Cory Itkin represented an offshore worker who was working off the Brazilian coast on a drill ship. While working, the plaintiff suffered broken bones in his non-dominant hand which required 4 surgeries to fix completely. It was the argument of his employer that the employee was at fault for placing his hand in a pinch point and that there should be no recovery because the employer had paid the full wages and medical bills of the injured employee until the doctor released him back to work. Arnold & Itkin, LLP took on the case and was able to secure a $1.5 million settlement which will ensure that the injured is given the help that he deserves as he moves into the next stage of his life. In the incident, our client has been carrying a mooring line to tie up a barge alongside a dock when the slack in the line suddenly became taut, jerking him backward. The defendant argued that the line only became tight because another worker let it fall into the water; that our client was only injured because he had improperly tied the line around his shoulder; and that our client had pre-existing injuries. The vessel owner’s doctor even argued that our client had been faking the injury. Despite these allegations, we were successful in recovering a $1.5 million settlement on behalf of our client. The case was pending in the Eastern District of Texas. The Honorable Marcia Crone was presiding.

Attorney's fees and expenses totaled $646,494.87.

Our firm still emerged victorious, reaching a favorable settlement.

Attorney's fees and expenses totaled $653,983.84.

$1.5 Million Settlement Secured for Injured Roustabout

Cory Itkin and Ryan MacLeod represented an injured Jones Act seaman. The man was working as a roustabout on an offshore drilling rig. Frustratingly, the defendant accused our client of lying about his injuries and tried to use security footage to prove this. However, Arnold & Itkin was able to produce compelling evidence that the company could have provided a safer process for the job that injured our client. We were able to settle as the case was pending trial.

The man eventually needed a three-level neck fusion to treat his injuries. The defendants argued that the accident never happened. Instead, they claimed that the worker was only suing because he was fired for failing a drug test a few days after the incident. They also alleged that the client had a long standing methamphetamine addiction and pointed to a woman who testified that the worker told her that he was going to make up a lawsuit to get some money. The defendants in the case tried arguing that the plaintiff was not entitled to any damages because he was taking prescription drugs at the time of the incident. They also argued that the plaintiff's injuries did not occur on the boat but were the result of a car accident that occurred two weeks after the accident on the dive boat. They alleged that the plaintiff suffered these injuries when his vehicle rolled over in the accident and that he had been drinking at the time.
