$76.6 Million Verdict Secured in Risperdal Case Against Johnson & Johnson

Attorneys Jason Itkin, Ces Tavares, and Kyle Findley of Arnold & Itkin won an impressive $76.6 million jury verdict on behalf of a boy who suffered gynecomastia, or irregular female breast growth. The verdict came against Johnson & Johnson and Janssen Pharmaceutical for their drug, Risperdal. The team was also assisted by Cory Itkin and Santana McMurrey from the firm. Both Jason and Kyle provided representation for the boy’s family, bringing a lawsuit against J&J for failing to provide a proper warning that their antipsychotic medicine, Risperdal, could lead to the development of female breasts. This verdict will help ensure that J&J is held accountable for causing such devastating disfigurement to Arnold & Itkin’s client.

J&J and Janssen Pharmaceuticals tried to argue that because their drug was the only drug that worked for the boy, he continued to stay on the drug—even though he was informed of the potential risks. They also tried to argue that Risperdal does not even cause gynecomastia, despite significant evidence that shows otherwise. Our team discovered pivotal evidence through careful cross-examination that was known in the case as “Tab 4.” It became crucial to our case and had never become public until the trial. This included scientific data that showed a clear link between Risperdal and the condition known as gynecomastia. Even though they had this information, J&J knowingly kept this evidence secret, hiding it from the FDA and burying it from scientific studies.

The Philadelphia jury found that Johnson & Johnson was guilty of falsifying, concealing, and/or destroying evidence. After just 11 days of trial, they unanimously agreed that J&J failed to warn of the side effects of Risperdal, thus causing our client to develop gynecomastia. They awarded our client $76.6 million—the largest single verdict in such a case.

Arnold & Itkin acted as trial counsel just one week before the trial took place, effectively demonstrating that the drug had a serious and harmful side-effect, gynecomastia—something the company failed to properly warn of. While J&J tried to deny that our client even had gynecomastia and suffered this as a result of taking Risperdal for several years as a boy, Jason and Cory prevailed in proving our client’s case, demonstrating J&J’s actions warranted just compensation.

BP Worker Injured in Crane Accident Receives a $1.72 Million Jury Verdict

Arnold & Itkin LLP secured a $1.72 million jury verdict on behalf of a client who was seriously injured in a crane accident at the BP refinery in Texas City, Texas. Attorney Cory Itkin represented Ernesto Tamez, who was injured in the accident on January 18, 2005.

A negligent Maxim Crane Works crane operator swung a heavy oil burner into Mr. Tamez, causing serious injuries to his neck, back and shoulder when he was pinned between the burner and a nearby handrail. Maxim Crane Works initially made no settlement offer prior to the trial, arguing that the accident was Mr. Tamez's fault. The company claimed that 60-year-old Tamez could have sustained some of the injuries as a result of "wear and tear". An issue that added complexity to the case was that Mr. Tamez and his wife do not speak English and therefore had to testify with the help of a translator.

The jury ruled in favor of Mr. Tamez after the week-long trial. They found that Maxim Crane Works was 100% at fault for the accident and awarded Mr. Tamez and his wife $1.72 million. Through the four years that this case lasted, Arnold & Itkin LLP stood by Mr. Tamez and helped him get the medical attention and financial compensation he needed. The case was pending in Galveston County, Texas. The Honorable Judge David E. Garner presided.

$1.7M Jury Verdict Won for Victim of Helicopter Crash

Arnold & Itkin Attorneys Cory Itkin and Caj Boatright represented a victim of a serious helicopter accident. Their client was an offshore fire and safety inspector who was being transported to an offshore platform at the time of the incident. The PHI helicopter experienced a tail rotor failure—causing the pilot to land in the Gulf of Mexico. The helicopter then flipped over in the water after it landed as the flotation devices had not been properly installed. Our client subsequently suffered from PTSD, as well as a severe back injury that eventually required surgery.

PHI argued they had done nothing wrong and that the entire incident could be blamed on the manufacturers of the tail rotor. They went on to claim that our client had not even been injured in the accident; they argued that the two other people who were involved in the crash were not injured and that our client had previously suffered from back problems and depression. PHI claimed that our client had been on pain medication for his back for years and that MRIs from a year prior to the accident were identical to those taken after the fact.

Despite the fact that PHI argued our client was faking his injuries, we stood by our client to successfully beat back the charges. We showed to the jury that our client was entitled to fair monetary compensation for the trauma that he had been put through. Not only were we able to obtain a $1.7M judgment in a jury trial, but we were also able to obtain a settlement with another party before the trial. The jury found that PHI was 100% to blame for the accident and they were therefore not entitled to receive any settlement credit.

Attorney's fees and expenses totaled $0.00.

$1.6 Million Recovered for Injured Offshore Employee

An offshore platform worker was injured after falling off a wireline on a scaffolding while trying to close a valve. However, the valve failed and released immense pressure. This caused him to fall over backward, injuring his neck to the point of needing surgery. Despite the efforts of the defendants to say that the worker was not to continue working on the broken valve, Maritime Attorney Cory Itkin was able to prove that the injury was preventable and the defendants were in fact responsible for his pain and suffering. They were able to reach a settlement of $1,650,000 on behalf of the injured offshore worker, allowing him now the opportunity to move on with his life. The case was pending in the Southern District of Texas with the Honorable Nancy Atlas presiding over it.

Attorney's fees and expenses totaled $728,111.75.

$1.65M Settlement for Kidnapped Seamen

Attorneys Cory Itkin, Kurt Arnold, and Jason Itkin worked to represent foreign seamen who were kidnapped and held hostage off the coast of Africa by a group of pirates. We sued our clients' employer stating that part of the reason for the kidnapping was a lack of proper security. Their employer attempted to get the case transferred to another country; they also claimed they were not responsible and that the pirates were wholly to blame. We beat back these allegations and were able to obtain a settlement of $1.65 million.

Plaintiff Recovers $1.55 Million Verdict Despite Pre-Trial Offer of $5000 Settlement

Attorney Cory Itkin represented client Michael LaFleur who had suffered a torn meniscus after being bumped from a commercial rig. The injury resulted in the client needed to have arthroscopic knee surgery. The commercial rig was owned by Conglobal Industries, Inc. who argued that the injury was not as severe as it was being made out to be and that it was, in fact, the plaintiff's fault for jumping in front of the big rig. The legal team from Arnold & Itkin, LLP worked together to show fault on behalf of the truck driver and were able to recover a $1,557,500 jury verdict despite the fact that before the case, there had only been a pre-trial offer of a $5000 settlement. The case was pending in Harris County, Texas before the Honorable Larry Weiman.

Attorney's fees and expenses totaled $464,709.80.

Low Speed Collision Victim Recovers $1.55 Million

On May of 2008, Gilberto Villegas was worked at the APM Terminals' marine terminal in Houston, Texas as a ship repairman when a pickup truck that he was standing on collided with a yard mule. This caused back injuries that resulted in the need for surgery. It was argued by the defendant that the driver of the yard mule was not at fault since the truck was in the middle of the intersection and that due to the low speed, it was a minor collision. They also argued that the plaintiff had injuries prior to the incident. They only offered to settle for $35,000. Attorneys Jason Itkin and Cory Itkin took on the case and were able to recover a $1.55 million jury verdict. The case was pending in Harris County, TX with the Honorable Jaclanal McFarland.

Attorney's fees and expenses totaled $582,749.75.

$1.5 Million Settlement Won for Man Injured on Drill Ship

Arnold & Itkin, LLP Attorneys Kurt Arnold & Cory Itkin represented an offshore worker who was working off the Brazilian coast on a drill ship. While working, the plaintiff suffered broken bones in his non-dominant hand which required 4 surgeries to fix completely. It was the argument of his employer that the employee was at fault for placing his hand in a pinch point and that there should be no recovery because the employer had paid the full wages and medical bills of the injured employee until the doctor released him back to work. Arnold & Itkin, LLP took on the case and was able to secure a $1.5 million settlement which will ensure that the injured is given the help that he deserves as he moves into the next stage of his life. The case was pending in Fort Bend County, Texas.

Attorney's fees and expenses totaled $741,838.78.

$1.5 Million Obtained for Injured Longshoreman

Attorneys Cory Itkin, Jason Itkin, and Kelly Woods helped represent a longshoreman who sustained a severe back injury in a line handling incident; the injury was severe enough to require multiple back surgeries as treatment. In the incident, our client has been carrying a mooring line to tie up a barge alongside a dock when the slack in the line suddenly became taut, jerking him backward. The defendant argued that the line only became tight because another worker let it fall into the water; that our client was only injured because he had improperly tied the line around his shoulder; and that our client had pre-existing injuries. The vessel owner’s doctor even argued that our client had been faking the injury. Despite these allegations, we were successful in recovering a $1.5 million settlement on behalf of our client. The case was pending in the Eastern District of Texas. The Honorable Marcia Crone was presiding.

Attorney's fees and expenses totaled $646,494.87.

$1,500,000 Verdict Obtained for Family in Wrongful Death Case

Arnold & Itkin filed a lawsuit on behalf of a family who had lost a loved one when he collapsed from a cardiac arrhythmia at the UPS warehouse where he was working that summer. The warehouse was not air conditioned. UPS argued that its warehouses rarely are. They further argued that the young man had needed his pacemaker since infancy and was well aware of the working conditions, having worked at that warehouse for the last six years. UPS had previously offered the family a $150,000 settlement before the case went to trial in Harris County, Texas. It takes a unanimous verdict to find a defendant guilty of gross negligence, which goes beyond ordinary negligence. Attorneys Cory Itkin and Ryan MacLeod secured this unanimous verdict to hold UPS accountable for its dangerous working conditions and to recover $1.5 million in compensation for the family.
Attorney's fees and expenses totaled $0.00.

$1.5 Million Recovered for Family Members after a Seaman Fell to His Death

A family recently came to us after their loved one fell to his death while working on a bridge construction project. The man was a 21 year old Jones Act seaman who died as a result of an overloaded crane which collapsed. While the defendants tried to hinder our clients' lawsuit by claiming that the family could not recover nonpecuniary damages and by claiming that the decedent's Mexican nationality would make recovery difficult, we were able to successfully obtain a $1.5 million settlement for the family to help them move forward emotionally after the accident.

Attorney's fees and expenses totaled $609,074.13.

Jones Act Seaman Acquires $1.45 Million Settlement

Arnold & Itkin LLP recovered a settlement of $1.45 million for an injured seaman who fell out of the ship's trash dumpster. The dumpster had been suspended in the air when the client fell, breaking his hip and wrist. He also developed Chronic Regional Pain Syndrome and was unable to return to work.

The defendant, a shipping company, originally argued that Arnold & Itkin LLP's client had already recovered from his injuries but had not returned to work because he was battling alcoholism. Attorneys Jason Itkin, Kurt Arnold and Cory Itkin were able to settle the case days before the trial was set to begin, proving that this argument was wrong. Arnold & Itkin LLP helped the injured seaman seek the medical treatment he needed as well as recover the financial compensation he deserved.

The case was pending in federal court in Baltimore, Maryland.

Attorney's fees and expenses totaled $640,864.23.

$1.375 Million Recovered on Behalf of Injured Seaman

While our client was releasing two barges on the Mississippi river, his foot got caught between two wires. He tried to radio his employer for help, but the employer had left the assigned post. Our client then tried to warn the pilot to not move the barges, but the barges moved anyway. Entrapped in the wires, our client’s left foot was amputated. He needed many surgeries and could no longer return to work. The attorneys at Arnold & Itkin fought hard to ensure that our client’s employer was held responsible for this highly preventable accident, ensuring that our client recovered the financial settlement needed to compensate him for immediate and long-term medical recovery and income losses. The defendants contested liability and the extent and nature of the young man’s serious injuries. The case was pending in Harris County District Court. Arnold Itkin was able to counter the defendants’ points and successfully negotiate a settlement for this young man prior to trial. $1.2 Million Won for Hurt Offshore Rigger

Arnold & Itkin attorney, Cory Itkin, recently recovered $1.2 million on behalf of an offshore rigger who hurt his back after falling from a platform located four feet from the boat he was aboard. The doctor recommended that our client undergo surgery to treat his injury. The defendants claimed that they did nothing wrong and argued that our client had previous injuries and a history of using prescription pain pills. Finally, they argued that our client's injuries were not as serious as we claimed and that our client was not even eligible for back surgery. Cory disproved these allegations and negotiated a financial settlement that will help our client move forward into a secure future. The case was pending in Harris County, Texas.

Attorney's fees and expenses totaled $546,645.65.
