$1.7M Jury Verdict Won for Victim of Helicopter Crash

Arnold & Itkin Attorneys Cory Itkin and Caj Boatright represented a victim of a serious helicopter accident. Their client was an offshore fire and safety inspector who was being transported to an offshore platform at the time of the incident. The PHI helicopter experienced a tail rotor failure—causing the pilot to land in the Gulf of Mexico. The helicopter then flipped over in the water after it landed as the flotation devices had not been properly installed. Our client subsequently suffered from PTSD, as well as a severe back injury that eventually required surgery.

PHI argued they had done nothing wrong and that the entire incident could be blamed on the manufacturers of the tail rotor. They went on to claim that our client had not even been injured in the accident; they argued that the two other people who were involved in the crash were not injured and that our client had previously suffered from back problems and depression. PHI claimed that our client had been on pain medication for his back for years and that MRIs from a year prior to the accident were identical to those taken after the fact.

Despite the fact that PHI argued our client was faking his injuries, we stood by our client to successfully beat back the charges. We showed to the jury that our client was entitled to fair monetary compensation for the trauma that he had been put through. Not only were we able to obtain a $1.7M judgment in a jury trial, but we were also able to obtain a settlement with another party before the trial. The jury found that PHI was 100% to blame for the accident and they were therefore not entitled to receive any settlement credit.

$950,000 Settlement for Jones Act Seaman

Cory Itkin and Caj Boatright obtained a settlement that paid a Jones Act seaman $950,000, plus all his past medical expenses (approximately $200,000) after just two days of trial. The total settlement will be worth approximately $1.15 million. The worker was injured when he tripped over a wire laying across the deck of a barge he was working on. This caused the seaman to fall overboard. He injured his back in the incident and eventually needed surgery to treat his injuries. The defendant argued that the wire was open and obvious and tried to blame the injured worker since he could have simply stepped around the trip hazard. The defendant also implied that the unwitnessed incident never occurred and that the injured deckhand simply made up the incident. Last, they argued that the worker was not really injured from the alleged incident. His employer pointed to a history of previous back injuries and noted that the plaintiff went to work for another company after the incident and passed an extensive pre-employment physical to obtain that job. The defendant’s highest offer of settlement before trial was only $200,000. After Cory and Caj obtained a favorable testimony at the start of the trial, the defendant increased its settlement offer to an amount that ensured the injured worker and his family would be taken care of while they move on to the next phase of their life. The case was tried to the bench (without a jury) in the Southern District of Texas with the Honorable Gray Miller presiding.

Although the defendant had refused to pay maintenance and cure for the seaman's injuries throughout the course of litigation—claiming that too much time had passed between the accident and the seaman's complaints of neck and back pain—Arnold & Itkin was able to make a strong case in our client's favor. The defendant blamed the seaman's carelessness for the accident, but our firm was able to show that the defendant was, in fact, negligent in failing to equip the ladder with slip resistant materials. The attorneys were also able to prove that the denial of maintenance and cure was improper. As a result, the defendant agreed to settle the case for $650,000 four days before trial.
