Attorney Jason Itkin

In an era where most cases settle, Jason Itkin is proud to be a trial lawyer who isn't afraid to take a case to trial if the other side isn’t being fair. Throughout his legal career, Jason has won billions for his clients. He never takes what happened to clients lightly and always fights to obtain the best results for their situation.

Jason has been a part of more than 25 verdicts where his clients won more than $1 million. Those verdicts include a $117 million verdict in Louisiana (which is the largest single-event personal injury verdict in the state’s history) and a record-setting $41 million verdict in Hawaii. Jason has also helped settle more than 100 separate cases for $1 million or more, including several cases in excess of $10 million. In the last year alone, Jason has won more than $1 billion in verdicts and settlements for his clients. Jason won these victories in courtrooms across the country—having represented clients in all 50 states.

His trial experience has earned him a national reputation among his peers and respect from the opponents who’ve faced him in court. In 2013, Jason was invited to become the youngest member of the Inner Circle of Advocates. The Inner Circle is an invitation-only group that honors the 100 best plaintiff trial attorneys in the nation. He has been repeatedly selected to various Super Lawyer lists and was honored as one of Houston’s top business leaders under the age of 40. Jason Itkin’s commitment to winning for his clients has led to more than 200 different attorneys hiring Arnold & Itkin LLP as co-counsel.

Importantly, Jason is a trusted advocate for workers injured while offshore. His maritime law results show that he’s a lawyer focused on making sure clients are treated right and that they have a fighting chance against some of the largest companies in the world.

Jason has been asked to work on the country’s primetime cases. If a case is in the news, Jason has likely been asked to help. Jason successfully represented the families who lost husbands and fathers when the El Faro cargo ship sank in a hurricane. After the Deepwater Horizon explosion, more injured workers trusted Jason over any other lawyer to handle their cases.

As a long-time resident of Texas, Jason attended the University of Texas, where he graduated with Special Honors in the Plan II Honors Program. He then graduated from the University of Texas Law School with Honors. While at UT, Jason earned the Dean's Achievement Award in Professional Responsibility and served as President of the Silver Spurs.

He is licensed to practice law in Texas, Pennsylvania, and before the Second and Fifth Circuit Court of Appeal, as well as before the U.S. Supreme Court. Jason has helped clients with situations that range from maritime accidents to industrial accidents to complex business disputes.

Jason has achieved record-breaking settlements because knowledgeable companies recognize that the outcome of a trial against Jason will result in a financial disaster. Recently, Jason tried a case where an insurance company refused to offer a fair settlement to his client. The company’s short-sighted position changed once Jason finished cross-examining the company’s “star witness.” After the questioning, the company fired its long-time lawyer. The next day, the company settled the case for nearly double what Jason’s client would have settled for in the pretrial stage. The company also formally apologized to Jason’s client for their mistake. This is what happens when you’re an attorney who refuses to back down from the results that clients deserve, no matter what.

Jason is married to Kisha Itkin, president of Theorem Vineyards. Together, with their daughter Alia and son Aric, the Itkins are active members and proud supporters of the Houston and Napa communities. When he isn’t helping clients, Jason and his wife assist with numerous community projects, both individually and through the Arnold & Itkin Foundation.

Jason Itkin's Case Results

Top 3 Largest Jury Verdict in U.S. History

In 2019, our firm—along with Thomas R. Kline at Kline and Specter—tried the very first punitive damages case against Johnson & Johnson for their drug Risperdal. The drug was originally developed to treat schizophrenia but was aggressively marketed off-label to children with autism and other behavioral disorders. Johnson & Johnson hid the dangerous side effect of its drug from the public, medical community, and F.D.A.

Our client was prescribed Risperdal and developed gynecomastia (female breast growth in boys). Our firm uncovered evidence that Johnson & Johnson knew about the link between their drug and gynecomastia, but didn’t turn it over to the FDA.

After a month-long trial, the jury returned with a verdict of $8 billion—the largest single-plaintiff jury verdict ever won in the Commonwealth of Pennsylvania, and the third largest jury verdict every obtained for an individual in the United States.

History-Making Verdict Won After Fatal Accident

On June 8, 2019, Kiersten Smith was making dinner in her apartment when a crane across the street fell onto her building. In a moment, she and her entire living room were gone. Kiersten’s mother called Arnold & Itkin once it was clear that the crane’s operators—a real estate developer called Greystar—were refusing to take responsibility for the crane collapse. After four years of shameless delay tactics, we took Greystar to court. In the end, the jury saw through Greystar and forced them to pay $860 million to our client for what they did.

$222 Million Verdict Won for Widow of Plant Worker

Attorneys Jason Itkin and Cory Itkin obtained a $222 million verdict for a woman whose husband Jesse suffered fatal burns over approximately 90% of his body in a plant accident. Jesse was sent to investigate a steam release from a faulty valve, but when the elevator doors opened, the steam burned Jesse. He was airlifted to a burn unit, but it was too late. Jesse died the next day. The faulty valve was traced back to Team Industrial Services, Inc., who denied responsibility until a jury heard the facts and ruled in our favor.

$117M Verdict Secured for Accident Victim

The firm is proud to announce the recent successful verdict that they won on behalf of their client, the victim of an ambulance accident. The plaintiff was seven months pregnant at the time of the accident (December 2010) when she was experiencing stomach pains and called for an ambulance. Acadian Ambulance picked her up a short time later to transport her to the hospital. What the woman didn't know and what Arnold & Itkin later proved was that the driver had a poor driving history and bad vision as well. While the ambulance was en route to the hospital, the driver dropped something on the floor and proceeded to pick it up. He took his eyes completely off of the road and did not slow down. As a result, the ambulance collided with the back of a sugar cane truck. The woman suffered a severed spine and serious brain injuries as a result.

She will never be able to walk again, and is permanently confined to the wheelchair. Also incredibly unfortunate is that her baby was born prematurely. Our client's baby and her other daughter were forced to live with the client's mother because she could no longer care for them with her disability. At the time the verdict was reached, the woman had already had to spend $1.4 million in medical bills. Throughout the course of the rest of her life, her medical bills are estimated to reach $30 million. The $117 million verdict is going toward the medical bills for the mother as well as all possible medical treatments needed for the premature child, as health complications may arise. Part of the verdict was also because the plaintiff's two children will not be able to have a healthy mother who can take care of them, and the pain and suffering that the mother sustained in addition to her physical wounds.

$76.6 Million Verdict Secured in Risperdal Case Against Johnson & Johnson

Attorney Jason Itkin and the team of lawyers from Arnold & Itkin won an impressive $76.6 million jury verdict on behalf of a boy who suffered gynecomastia, or irregular female breast growth. The verdict came against Johnson & Johnson and Janssen Pharmaceutical for their drug, Risperdal. The team was also assisted by Cory Itkin and Santana McMurrey from the firm. Both Jason and Kyle provided representation for the boy’s family, bringing a lawsuit against J&J for failing to provide a proper warning that their antipsychotic medicine, Risperdal, could lead to the development of female breasts. This verdict will help ensure that J&J is held accountable for causing such devastating disfigurement to Arnold & Itkin’s client.

J&J and Janssen Pharmaceuticals tried to argue that because their drug was the only drug that worked for the boy, he continued to stay on the drug—even though he was informed of the potential risks. They also tried to argue that Risperdal does not even cause gynecomastia, despite significant evidence that shows otherwise. Our team discovered pivotal evidence through careful cross-examination that was known in the case as “Tab 4.” It became crucial to our case and had never become public until the trial. This included scientific data that showed a clear link between Risperdal and the condition known as gynecomastia. Even though they had this information, J&J knowingly kept this evidence secret, hiding it from the FDA and burying it from scientific studies.

The Philadelphia jury found that Johnson & Johnson was guilty of falsifying, concealing, and/or destroying evidence. After just 11 days of trial, they unanimously agreed that J&J failed to warn of the side effects of Risperdal, thus causing our client to develop gynecomastia. They awarded our client $76.6 million—the largest single verdict in such a case.
Attorney's fees and expenses totaled $0.00.

The companies responsible chose to settle with our client a week before trial was set to begin—giving him the financial security and access to medical care he needs. The settlement is potentially a record-setting size, which has compelled the companies involved to change their policies and ensure this never happens to another worker.
